A babysitter who killed a six month-old boy after she was caring for after falling on top of him has escaped jail.

Kelly Schneeberger, 42, was handed two years probation for killing Byron Matlock on Tuesday, leaving her victims father furious.

Darrell Matlock, of St Charles, Mo., told Fox2: The judge seemed like its no big deal and (the) prosecuting attorney has no care at all and our family has been torn apart.

He said Schneeberger had been caring for Byron for a year with no issues.

But after the accident in October 2016, she initially tried to blame Byrons then two year-old brother for the traumatic brain injury, who she also cared for.

Schneeberger initially told investigators that the tragic baby had died after the toddler had fallen on him, causing him to hit the ground.

She later changed her story to admit that she herself had fallen on the child, with Byrons mom Bree Rager saying at the time: Thats the big thing right there, that she tried to blame a baby who couldnt speak for themselves.

The babysitter was charged with endangering the welfare of a child, a misdemeanor that only carries a maximum 12 month prison sentence.

After Tuesdays hearing, Darrell Matlock also hit out at St Charles County for the light punishment, saying: I just feel St. Charles County has done a poor job.

They are supposed to make people pay for what theyve done and hold them accountable.

Schneeberger has been banned from working with kids for life.
